1. Introduction
Welcome to Hess Media. By using our services, including but not limited to photography, videography, equipment rentals, and event production, you agree to be bound by these Terms and Conditions. Please read them carefully as they outline the rights and responsibilities of both parties.

2. Services
Hess Media offers the following services:
- Professional Videography and Photography for events, weddings, and corporate clients.
- Promotional Video Production for businesses.
- Equipment Rentals for video walls, lighting, and sound systems.
- Event Coverage including but not limited to live streaming and on-site technical support.
3. Bookings and Payment Terms
3.1 Quotes and Proposals
All quotes and proposals provided by Hess Media are valid for 30 days unless stated otherwise. After this period, the terms, pricing, and availability may change without notice.
3.2 Deposits and Payment Schedule
A non-refundable deposit of 30% is required to secure all bookings, payable upon acceptance of the quote. The remaining balance is due no later than 7 days prior to the event or project start date. Payment methods include credit card, bank transfer, and e-transfer.
3.3 Cancellations and Refunds
- Client Cancellations: If a client cancels the service more than 30 days before the scheduled date, the deposit will be retained, but no further charges will apply. For cancellations within 30 days, 50% of the total fee will be charged.
- Hess Media Cancellations: If Hess Media cancels a booking due to unforeseen circumstances, a full refund will be provided, and we will work with you to find an alternative solution.
4. Equipment Rental Terms
4.1 Rental Agreement
All equipment rentals are subject to availability and must be booked at least 7 days in advance. Clients must sign a rental agreement detailing the equipment, rental period, and conditions for use. A security deposit may be required based on the equipment type and value.
4.2 Liability
The client assumes full responsibility for the equipment from the time of delivery until it is returned. Any damage, loss, or theft of the equipment will be charged to the client at full replacement value.
4.3 Delivery and Setup
Hess Media offers delivery and setup services at an additional cost. If opting for self-pickup, clients are responsible for ensuring safe transport and handling of all rented equipment.
5. Event Coverage and Service Delivery
5.1 On-Site Conduct
Our team will adhere to a professional code of conduct during all events. We reserve the right to refuse or terminate services in the event of unsafe working conditions, harassment, or unreasonable requests.
5.2 Client Obligations
Clients are responsible for providing accurate and detailed information regarding event schedules, special instructions, and any venue restrictions that may impact the delivery of services.
5.3 Copyright and Licensing
All footage and images captured by Hess Media are the intellectual property of Hess Media unless otherwise specified in a written agreement. Clients are granted a license for personal and commercial use, but any modifications, resale, or redistribution must be approved in writing.
6. Post-Production and Deliverables
6.1 Editing and Revision Policy
Hess Media provides high-quality post-production services, including color correction, audio mixing, and special effects. Up to two rounds of revisions are included in the quoted price. Additional revisions will incur extra charges.
6.2 Delivery Timeline
Standard delivery times are 4–6 weeks for full video production projects and 2–4 weeks for photography projects. Rush services are available for an additional fee.
6.3 Format and Storage
All final files will be delivered digitally unless otherwise requested. Physical copies such as DVDs or USB drives can be provided at an additional cost. Hess Media will store raw files for up to 6 months after project completion. After this period, raw footage may be deleted unless archival services are arranged.
7. Liability and Indemnification
Hess Media will not be held liable for any direct or indirect damages, including but not limited to data loss, project delays, or any incidents arising from equipment malfunction. The client agrees to indemnify and hold Hess Media harmless from any claims, actions, or damages resulting from the use of our services.
8. Force Majeure
Hess Media will not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, strikes, or governmental restrictions. In such cases, both parties will work together to reschedule the service or reach an amicable resolution.
9. Governing Law
These Terms and Conditions are governed by the laws of the Province of British Columbia, Canada, without regard to its conflict of laws principles. Any disputes arising from these Terms and Conditions will be settled in the provincial courts of British Columbia.
10. Changes to Terms and Conditions
Hess Media reserves the right to update or modify these Terms and Conditions at any time without prior notice. Any changes will be posted on our website and will take effect immediately. It is the client’s responsibility to review these terms periodically.
